亚马逊平台上的各种侵权事件层出不穷，选品稍不注意就会遭到投诉，一旦被投诉侵权，亚马逊就会马上对被投诉方做出处决，轻则发通知警告，下架产品，取消销售权限，重则直接封号。但由于亚马逊内部审核人员的水平不一，通常会有误判的操作，即涉案ASIN的产品并不侵犯投诉方的知识产权，但亚马逊审核人员仍然采取了下架措施的这一判断结果，这明显是对被投诉方更不公平的一种情况。

申诉成功案件 –成人用品
近日以来，赛贝已为两个成人用品类目大卖成功申诉回来两条链接，均涉及Novoluto, GmbH的两个不同的美国发明专利。Novoluto是德国的一家专注于成人用品知名大企业，在美国拥有多项发明、外观专利，并且经常在美国联邦法院提起诉讼案件进行维权，因此Novoluto的相关专利在亚马逊上权重更高，更容易把链接投诉下架，相对来说，我们的申诉难度也更大。

由于篇幅受限，本文将只详细阐述美国发明专利9937097（下称097专利）中所涉及的技术特征。097专利公开了一种具有具有柔性壁部的腔室的刺激装置。更具体的说，通过控制柔性壁部分的偏转方向和程度，可以调节腔室内的压力和体积变化，以实现特定的刺激效果。097专利一共有四个独立项，分别为权利要求1、12、17、26。
